Definitions

The terms used have the following definitions:

  1. The Site: refers to the website accessible at the URL address of this policy;
  2. The Editor: refers to the organization responsible for the Site, as defined in the Legal Notices accessible on the Site;
  3. Visitor: refers to any person who browses and uses the Site;
  4. "Terms of Use" and "TOU": terms referring to these, including the Personal Data Protection Policy accessible on the Site.

Article 1. Purpose

These General Terms of Use (hereinafter referred to as "the TOU") determine the rules of access, the terms of use of the services of the Site, as well as the rights and responsibilities applicable to any Visitor of the Site. The TOU are freely accessible and can be consulted by anyone browsing/using the Site.

The Data Protection Policy, which can be consulted on the Site, is an integral part of the General Terms of Use and must be expressly and unreservedly accepted by Visitors/Supporters if they wish to continue browsing and using the Site.

The TOU must be accepted without reservation and in their entirety by anyone wishing to access, browse, and use the Site. They constitute the contract between the Editor and any Visitor of the Site.

Visitors are advised to print a copy of the TOU and consult them regularly.

Article 2. Description of Provided Services

The purpose of the Site is to:

  1. provide information about all of the Editor's activities;
  2. allow Visitors to stay informed about the Editor's activities;
  3. allow Visitors to provide their information to the Editor for the purpose of organizing the Editor's activities (events, field mobilization, ...), in case these functionalities are activated on the Site;

Article 3. Access to the Service

The Site is normally accessible at all times to users. However, an interruption for technical maintenance reasons may be decided by the Editor, who will endeavor to communicate the dates and times of the intervention to users in advance.

To access the Site, the Visitor must have personal computer equipment free of viruses, Trojan horses, logic bombs, computer worms, and any other undesirable program that could disrupt the operation and use of the Site and/or browsing on the Site.

The Visitor agrees to regularly update their equipment, materials, and software and connections necessary for the normal functioning of the Site.

Article 4. Limitations of Liability

The Editor strives to provide information on the Site as accurately as possible. However, it cannot be held responsible for omissions, inaccuracies, and deficiencies in updating, whether they are its own or the fault of third-party partners who provide this information.

All information provided on the Site is for indicative purposes and may change. Furthermore, the information on the Site is not exhaustive. It is subject to changes that may have been made since it was posted online.

Article 5. Contractual Limitations on Technical Data

The Editor and the publishing director cannot be held responsible for direct and indirect damage to the user's equipment when accessing the Site. Any form of warranty is therefore excluded in case of damage.

To the extent that interactive spaces may be made available to users, the publishing director reserves the right to delete, without prior notice, any content deposited in these spaces that would contravene applicable French law, especially regarding data protection. Where applicable, the publishing director also reserves the right to invoke the civil and/or criminal liability of the user, particularly in the case of messages that are racist, insulting, defamatory, or pornographic, regardless of the medium used (text, photography...).

Article 5. Intellectual Property and Counterfeiting

The Editor owns the intellectual property rights or holds the rights to use all the elements accessible on the site.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, by any means or process whatsoever, is prohibited, except with the prior written authorization of the publishing director.

Any unauthorized use of the site or any of its elements will be considered as constituting an infringement and will be pursued in accordance with the provisions of articles L.335-2 and following of the intellectual property code.

Article 6. Nullity

If one or more clauses of these TOU are declared null or invalid pursuant to a law, regulation, or a final decision of a competent court, the other articles/clauses will retain their full force and effect.

Article 7. Modification of the TOU

The Editor reserves the right to make any changes and corrections/evolutions to these TOU. The new TOU will cancel and replace all previous General Terms of Use.

Article 8. Duration

The TOU apply from the first connection to the Site and during its use. The duration of these TOU is indefinite.

Article 9. Applicable Law

These TOU are governed by Austalian law. Only the Australian version will be valid. Any translations of these TOU are provided for convenience only.

Any dispute arising from the use of the Site, or the application and interpretation of these General Terms of Use or support for the Tribune, its consequences, and its consequences are subject to French law and the jurisdiction of French courts.
